These terms are the agreement between you and us for using TakeawaysNearMe.ie, claiming and managing a listing, and buying ads. Please read them with our Privacy Policy, Cookie Policy and Disclaimer.

1. About these terms

The site is run by [Legal entity name] (“we”, “us”), details in section 20. By using the site you accept these terms. If you act for a business, you confirm you may bind it. Accounts are for people aged 16 or over.

2. What we provide

A directory of takeaways in Ireland, built from Google Places data, owner input and our staff's work, with AI-written text that is labelled (see the AI notice). We do not take food orders or payments for food, inspect businesses, or endorse any listing. We host content that owners and advertisers give us, which makes us a hosting service under the EU Digital Services Act (Regulation (EU) 2022/2065, “DSA”).

3. Accounts

  • Give accurate details, keep your password to yourself and tell us at hello@takeawaysnearme.ie if you think someone else used your account.
  • You need to confirm your email before you can sign in.
  • You can delete your account at any time from Account → Profile.

4. Listing accuracy

We try to keep listings right but cannot promise every detail is current. Check with the business before you travel or order. Our Disclaimer explains the limits in full.

5. Claims and verification

If you own or are authorised to manage a listed business, you can claim its listing. When you claim, you confirm that you are entitled to act for the business and that what you tell us is true. Our staff review each claim and may ask for more information, contact the business on its public number, or refuse, withdraw or transfer a claim if the evidence is not convincing or a dispute arises. We email you our decision and, if we refuse, our reason. A false claim may lead to account closure and may be an offence.

An approved claim lets you request changes to details, upload photos and see your listing's statistics. Changes to details are reviewed by our staff before they appear.

Paid verification is planned but not offered yet. Before it is, we will publish what it includes, its price and its cancellation and refund terms, and you will only pay if you choose it.

6. Content you give us

You keep ownership of text, photos and ad material you give us. You grant us a non-exclusive, royalty-free licence, for as long as the content is on the site and a reasonable time after removal (for backups and caches), to host, copy, resize, format and display it on TakeawaysNearMe.ie and in previews of our pages (for example in search results and social media), so we can run and promote the directory. You confirm you have the rights to it, that it is accurate and lawful, and that people shown in photos agreed. We may edit content for length, format or accuracy, or remove it (section 10).

7. Acceptable use

You must not:

  • submit false claims, impersonate a business or person, or post false or misleading information;
  • upload content that is illegal, infringes someone's rights, or includes other people's personal data without a lawful reason;
  • list or promote a venue mainly selling alcohol (we do not list pubs, bars, off-licences or nightclubs);
  • scrape or bulk-copy the directory, or use bots, except search engines that follow our robots.txt;
  • try to get around rate limits, break into accounts or systems, or disrupt the site;
  • use contact details on the site to send spam.

8. Removing a listing

A business that does not want to be listed can ask us to remove it, free of charge, by emailing hello@takeawaysnearme.ie from an address linked to the business (or telling us how we can check the link). You do not need an account or a claim. We take the listing off the site and keep only its Google Place ID on an exclusion list so that it is not added again. Data protection rights, including erasure and objection, are always free; see Privacy Policy, section 9.

9. Reporting illegal content

Anyone can tell us about content on the site they believe is illegal (DSA Article 16), for example an infringing photo, a fake listing or a misleading ad. Email hello@takeawaysnearme.ie with the subject “Illegal content report” (or use the “Report this listing” link at the foot of a restaurant page, which fills in the subject and page address) and include:

  1. why you believe the content is illegal;
  2. the exact page address (URL) and which part of the page;
  3. your name and email address (not needed for reports of child sexual abuse material and similar offences);
  4. a statement that you believe in good faith that the report is accurate and complete.

We confirm receipt, review the report carefully and impartially, decide within a reasonable time, and tell you the outcome and how you can challenge it. Reports are handled by people, not automated tools. If we learn of information suggesting a criminal offence involving a threat to someone's life or safety, we tell An Garda Síochána. For inaccurate (but not illegal) details, just email us.

10. How we moderate

We may refuse, edit, hide or remove content, reject or withdraw a claim, pause or remove an ad, or suspend or close an account if content or conduct is illegal or breaks these terms. Our staff decide, using these terms and the law; software only applies fixed rules such as the alcohol-venue check and listing-name checks. We act proportionately, with regard to everyone's rights, including freedom of expression.

If we restrict something you provided, we tell you by email (if we have your address) with a statement of reasons (DSA Article 17): what we did, the facts, the term or law relied on, whether it followed a report, and how to challenge it. You can reply to ask us to look again, go to court, or complain to Coimisiún na Meán, Ireland's Digital Services Coordinator.

11. Points of contact (DSA)

Our single point of contact for users and for authorities, the European Commission and the European Board for Digital Services (DSA Articles 11 and 12) is hello@takeawaysnearme.ie. We accept messages in English.

12. Sponsored ads

Ads are sold to businesses. Start with the form on /advertise; we then agree each booking with you in writing (an order by email), stating the ad, placement, targeting, dates and price. The order and these terms together form the contract.

  • Labelling: every paid ad is marked “Sponsored” and shows your business name. We may tell people who paid for an ad.
  • Targeting: by page context only (type of page, county, town, cuisine). We do not target by personal data or behaviour. On a claimed or verified restaurant's page, other takeaways' ads are not shown.
  • Your ad: must be accurate, legal and yours to use, must not promote alcohol venues, and must link to a working site. We may decline an ad or ask for changes.
  • Reporting: we share daily impressions and clicks. These are our counts; we do not guarantee traffic, enquiries or sales.
  • Payment: as set out in the order. Prices are shown in euro and state whether VAT is included.

13. Cancellations and refunds

For ads (unless your written order says otherwise):

SituationWhat happens
You cancel before the ad startsFull refund of anything you paid for it.
You cancel after the ad has startedThe ad stops within one working day and we refund the unused part of the booked period, pro rata by day, unless your order says otherwise.
We cannot show the ad as booked (for example the site or rail is unavailable for more than 24 hours in a row, or we place it wrongly)You choose: we extend the booking by the time lost, or refund that part pro rata.
We remove the ad because it breaks these terms or the lawThe ad stops. We may keep payment for the period it ran; any refund of the rest is at our discretion, unless the law requires one.
Impressions or clicks are lower than you hopedNo refund: we do not guarantee traffic or results.

Refunds go back to the original payment method within 14 days of being agreed. Ask at hello@takeawaysnearme.ie.

Our paid services are for businesses. If you buy as a consumer, you also have a 14-day right to cancel a contract made at a distance under the Consumer Rights Act 2022; if you ask us to start within those 14 days and then cancel, you pay for what was provided up to then. Nothing in these terms affects your statutory rights.

14. Our content and data

The site's design, code and our own text belong to us or our licensors. The directory as a whole is protected as a database. You may share links and quote small parts with credit; anything more needs our written permission. Google data stays subject to Google's terms, and business names and logos belong to their owners.

15. Other sites and services

Links to business websites, maps and delivery apps take you to services run by others, under their own terms. We are not responsible for them, or for any transaction you make with a listed business.

16. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else that Irish or EU law does not allow to be limited, and nothing affects your rights as a consumer.

Subject to that: the directory is provided as it is, and we are not liable for loss caused by listing details being wrong. For business users and paid services, we are not liable for loss of profit, revenue or goodwill, or for indirect loss, and our total liability in any 12 months is limited to the amount you paid us in that period. If you use the site for a business, you will cover our reasonable costs of claims caused by content you gave us or your breach of these terms.

17. Suspension and closure

We may suspend or close an account, or stop an ad, as described in section 10, with a statement of reasons. You may stop using the site or delete your account at any time. Sections 6, 13, 14, 16 and 18 continue after closure.

18. Law and disputes

These terms are governed by the law of Ireland, and the courts of Ireland have jurisdiction. If you are a consumer living elsewhere in the EU, you keep the protection of your own country's mandatory consumer law and may also bring proceedings there. Please contact us first; most issues can be sorted out quickly.

19. Changes

We may update these terms when our services or the law change. We will show the new date at the top and, for significant changes, give notice on the site or by email to account holders and advertisers before they take effect. Changes do not affect an ad order already agreed unless you accept them. If you do not agree, you can stop using the site and delete your account.
